Terms and Conditions of Bnamard Hiking Tours

1. Introduction

These Terms and Conditions apply to all hiking tours, activities, and related services organized and led by Bnamard (hereafter referred to as “the Organizer”). By booking, participating in, or signing up for any tour, you confirm that you have read, understood, and agreed to these Terms and Conditions.

Hiking and outdoor activities involve inherent risks. These Terms are designed to clarify responsibilities, expectations, and risk acceptance for all participants.

2. Participation Requirements

By joining a hiking tour, you confirm that:

  • You are physically and mentally fit to participate in outdoor hiking activities.
  • You have honestly disclosed any relevant medical conditions, allergies, injuries, or limitations before the tour.
  • You understand the difficulty level of the hike and confirm that it matches your experience and physical condition.
  • You agree to follow the instructions and decisions of the guide at all times.

The Organizer reserves the right to refuse participation or remove a participant from a tour if their condition, behavior, or actions put themselves or others at risk.

3. Assumption of Risk

You acknowledge and accept that hiking and nature-based activities involve inherent risks, including but not limited to:

  • Uneven terrain, falling rocks, slips, trips, and falls
  • Weather changes, extreme temperatures, and natural hazards
  • Wildlife encounters and insects
  • Physical exhaustion, dehydration, altitude-related effects
  • Limited or delayed access to medical care

By participating, you voluntarily assume full responsibility for all risks associated with the activity, whether known or unknown, foreseeable or unforeseeable.

4. Personal Responsibility

Each participant is responsible for:

  • Bringing appropriate clothing, footwear, food, and water as advised
  • Using equipment correctly and safely
  • Monitoring their own physical condition during the hike
  • Informing the guide immediately if they feel unwell, injured, or unable to continue

Failure to follow safety instructions, rules, or guidance may result in removal from the activity without refund.

5. Limitation of Liability

To the fullest extent permitted by law:

  • The Organizer, guides, partners, volunteers, and affiliated persons shall not be held liable for any injury, illness, loss, damage, accident, delay, or expense arising from participation in the tour.
  • This includes, but is not limited to, personal injury, death, property loss or damage, or emotional distress.

Participation is entirely at your own risk.

6. Medical Emergencies

In the event of an accident or medical emergency:

  • The Organizer may arrange basic first aid or emergency assistance when possible.
  • You authorize the Organizer to seek emergency medical treatment on your behalf if necessary.
  • All medical, evacuation, and related costs are the sole responsibility of the participant.

It is strongly recommended that participants have valid travel and medical insurance that covers hiking and outdoor activities.

7. Weather, Route Changes, and Cancellations

  • Routes, schedules, and destinations may change due to weather conditions, safety concerns, natural events, or unforeseen circumstances.
  • The Organizer reserves the right to modify or cancel a tour for safety reasons.
  • Such changes do not entitle participants to compensation beyond what is explicitly stated in the cancellation policy.

8. Group Conduct

Participants agree to:

  • Respect nature, wildlife, and local communities
  • Follow Leave No Trace principles
  • Treat guides and fellow participants with respect

The Organizer reserves the right to remove any participant whose behavior is disruptive, unsafe, or disrespectful, without refund.

9. Photography and Media

During tours, photos or videos may be taken for documentation or promotional purposes.

  • By participating, you grant permission for your image to be used unless you explicitly state otherwise in writing before the tour.

10. Minors

Participants under 18 years of age must:

  • Be accompanied by a parent or legal guardian, or
  • Provide written consent from a parent or legal guardian prior to participation

11. Governing Law

These Terms and Conditions are governed by the laws of the Republic of Armenia. Any disputes shall be resolved under the applicable national legislation.

12. Acceptance of Terms

By booking, signing, or participating in a tour, you confirm that:

  • You have read and understood these Terms and Conditions
  • You voluntarily accept all risks involved
  • You release the Organizer from liability to the maximum extent permitted by law
